1. Who we are and what these terms cover
These Terms of Service apply to games made available under the Specialbit Studio brand and related services that we provide for those games. Specialbit Studio is operated by Dmytro Ihorovych Cheglakov, a Ukrainian sole proprietor ("we", "us", or "our"). You can contact us at [email protected].
Please read these terms before using a game. By using a game, you agree to these terms to the extent permitted by applicable law. If you do not agree, do not use the game, and consult the seller about any cancellation or refund rights. These terms do not remove any rights that you already have under a purchase contract or mandatory law.
2. Eligibility and age ratings
You must comply with the age rating and eligibility requirements of the game and the store or platform through which you access it. If you are not legally able to enter into this agreement on your own, a parent or legal guardian must review and agree to these terms and authorize your use and any purchases, where required by law.
3. Your licence to play
When you lawfully obtain a game, we grant you a limited, non-exclusive licence to install and play it for your personal, non-commercial entertainment, subject to these terms and the applicable purchase and platform conditions. You do not acquire ownership of the game’s intellectual property.
The licence covers the copies and devices permitted by your purchase and platform rules. Nothing here restricts uses, transfers, backups, accessibility measures, or other activities that applicable law permits and that cannot lawfully be restricted by contract.
4. Acceptable use
You must not unlawfully copy, distribute, sell, rent, sublicense, or commercially exploit a game or its content; circumvent technical protections unlawfully; or reverse engineer, decompile, or modify a game except where permitted by applicable law or by our express permission.
You must not use a game or a related service to break the law, infringe another person’s rights, distribute malicious code, gain unauthorized access to systems or accounts, or interfere with the security or operation of our services. If a game includes online or community features, do not cheat, harass other people, or disrupt their use of those features.
5. Purchases, payments, and refunds
Games may be offered through third-party stores or platforms. The product listing and checkout identify the seller, price, applicable taxes, payment conditions, system requirements, and any additional purchase terms. The store or platform’s terms also apply to transactions made through it. These terms do not change who is responsible for a particular sale.
For billing, cancellation, or refund requests, contact the store or seller shown on your receipt, or contact us for help. A store’s refund policy is additional to any mandatory rights you have. Nothing in these terms makes all purchases non-refundable or excludes remedies for faulty, misdescribed, or undelivered digital content.
Where a statutory withdrawal or cooling-off right applies, it remains available unless the legal requirements for an exception have been met. Starting a download or playing a game does not, by these terms alone, waive that right. Any legally required express consent, acknowledgement, and confirmation must be obtained through the applicable purchase process.
6. Updates, compatibility, and availability
Check the game’s store page for its supported devices, operating systems, features, and system requirements before purchase. You are responsible for providing a compatible device and any connection needed to download or use the game. Install updates that are necessary for security or proper operation when they are made available.
We may provide patches and updates and make changes needed to maintain a game, address security issues, or comply with law. We will provide updates, notices, and remedies required by applicable law and honour the commitments made for your purchase. These terms do not give us an unrestricted right to remove paid content, materially reduce purchased functionality, or end access contrary to your contract or mandatory rights.
Online features, where offered, may be interrupted for maintenance or circumstances outside our reasonable control. Any discontinuation or material change will be handled in accordance with applicable law, including required advance information and any cancellation, refund, or other remedy.
7. Intellectual property
The games and their artwork, music, sound, stories, characters, software, names, logos, and other content are protected by intellectual property laws. Rights belong to us or the relevant licensors and rights holders. Except for the licence granted here, permissions we expressly give, and rights provided by law, all rights are reserved.
8. Third-party stores and services
A game may be distributed through, link to, or use third-party platforms and services. Their own terms and privacy notices apply to their services. We are responsible for our obligations and conduct; the third-party provider is responsible for its own services to the extent provided by law. Nothing here excludes responsibility that cannot lawfully be excluded.
9. Privacy
Personal data practices are described in the privacy policy for the particular game. Please use the Privacy Policy link on that game’s page at specialbit.com or in its store listing or in-game information. Different games may use different features, services, and data practices.
These terms do not replace or amend any per-game privacy policy and do not constitute consent to personal data processing. A store or third-party service may process data under its own privacy notice.
10. Statutory consumer rights
Nothing in these terms excludes, limits, or waives any mandatory consumer rights or other protections under applicable law. These include, where applicable, rights to digital content that conforms to its description, meets required quality and fitness standards, and receives required updates, as well as rights to repair, replacement, price reduction, cancellation, or refund.
If you are a consumer, you retain the mandatory protections of the country in which you habitually reside where those protections apply. Any provision that conflicts with a mandatory protection applies only to the extent permitted by law, and that protection takes priority.
11. Responsibility and liability
We are responsible for performing our contractual and legal obligations. To the extent permitted by applicable law, we do not guarantee that a game will be free from every error or interruption, or compatible with devices and software outside its stated requirements. These statements do not reduce any statutory guarantee or obligation to remedy a lack of conformity.
To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was made, or for business losses arising from use of a game supplied for personal entertainment. We do not exclude or limit liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
12. Ending use and addressing breaches
You may stop using a game at any time. Stopping use does not, by itself, create or remove any right to a refund.
If you materially breach these terms, we may take proportionate action permitted by law, including restricting affected online features or ending the licence where legally justified. Where appropriate and required by law, we will explain the reason and give you notice and an opportunity to remedy the breach. Immediate action may be necessary to address a serious security risk or unlawful activity. Any action remains subject to your statutory rights and available remedies.
13. Changes to these terms
The last-updated date identifies this version. If we change these terms, we will publish the revised version and give any notice required by law. Material changes affecting an existing contract will take effect only where legally permitted and after any required notice or agreement.
Changes do not apply retrospectively to remove rights relating to earlier purchases or events. Continued use alone will not be treated as acceptance where the law requires express agreement.
14. Governing law and disputes
These terms are governed by the laws of Ukraine, subject to any mandatory law that applies to you. If you are a consumer, this choice does not deprive you of mandatory protections afforded by the law of your habitual residence where applicable.
Please contact [email protected] if you have a concern so that we can try to resolve it. Contacting us first is not a condition for exercising your legal rights. You may bring a claim before any court that has jurisdiction under applicable law, including courts in your country of residence where the law permits. These terms do not require arbitration or waive rights to collective proceedings or complaints to consumer protection authorities.
